1. Despite popular belief, Untitled Property in Panama is not a type of squatter’s rights in Panama. In fact, unlike other Central American Countries, squatters do not enjoy rights to Panama land that they occupy. Untitled Property, also referred to as “Right of Possession” (ROP) and Derecho Posesorio in Spanish, is something different.
Untitled property in Panama is property that is owned by the Panamanian Government. At some point the government of Panama gave certain Panamanians the right to occupy the land. The true owner of the land is the Panamanian Government, not the owner of the “Rights of Possession.” However, the Rights of Possession owner does have the option to buy the land from the Panamanian Government.
2. The owner of the Rights of Possession (ROP) does own any improvements that have been made to the land while they occupied it. These improvements to the Panama real estate may include landscaping, fences, well, and structures such as a house.
3. The legislation that regulates and controls Untitled Property or Derecho Posesorio Property in Panama is quite ambiguous and potential buyers often find themselves victims to individuals’ interpretation. It is extremely important to work with a qualified lawyer who specializes in Panama real estate and do your homework before entering a contract to purchase Untitled Property in Panama. Have a lawyer check to ensure the Panama property is free of any liens.
4. All land that falls between 22 meters and 300 meters from the point of the highest tide constitutes the zone of the Rights of Possession when discussing Panama Real Estate.

9. Check the current Rights of Possession bearer’s status with the local Panama government office. Panamanian municipalities and government bureaus are meticulous for documenting and archiving information. Ensure the current owners name appears in the government’s office archives that corresponds to the particular Panama real estate.
10. Have the local corresponding Panama government office (this will vary according to the category of Rights of Possession property) arrange to visit the property in Panama and verify the survey.
